While serving a 16 year sentence for manslaughter for killing his mother, Tavares assaulted two prison guards. The Worcester District Attorney wanted Tavares held on $50,000 bail for the assault after he served his time. Judge Tuttman reversed this decision and set Taveares free without a monitoring device. When he went to collect a debt from Brian Mauck, who according to Taveres was insulting. Taveres shot both Mauck and his wife Beverly. | |||

Andover resident Kathe Tuttman, formerly a prosecutor in the Essex County District Attorney's Office, became a Superior Court Judge in May 2006 - an appointee of Governor Romney. In November of 2007, Governor Romney called for her resignation after she freed Daniel Tavares Jr. on his own recognizance.
